On 23 May 2024, the Basic Law of the Federal Republic of Germany will be 75 years old. As the highest instance of the judiciary, the Federal Constitutional Court is responsible for asserting its validity: a task that also involves scrutinising executive decisions, sometimes even to the point of demanding corrections. The constitutional guardian in Karlsruhe is therefore one of the essential pillars of the liberal and democratic German constitutional state. Peter M. Huber, professor of public law and philosophy of state, was a justice on the Federal Constitutional Court for 13 years; the current Chairman of the Konrad Adenauer Foundation Norbert Lammert was President of the German Bundestag for 12 years. Both men look back on many years of experience in different areas of shared state power and discuss the relationship between the judiciary and the executive branches.
